Delaware River Joint Toll Bridge Commission v. George Harms Construction Co., Inc.
The Delaware River Joint Toll Bridge Commission (Commission), a bi-state entity created by an interstate compact between New Jersey and Pennsylvania, sought to replace the I-95 Scudder Falls Bridge. The Commission decided to use a Project Labor Agreement (PLA) for the project, which required contractors to hire at least 75% of their workforce from specified local unions. George Harms Construction Company, Inc. (Harms), which had a collective bargaining agreement with a different union, challenged the PLA, arguing it was unlawful because it excluded their union.The trial court denied Harms' request for a preliminary injunction and dismissed Harms' counterclaims, ruling that New Jersey’s competitive bidding laws did not apply to the Commission. However, it also dismissed the Commission’s complaint, stating the lawsuit was not properly authorized by the Commission as a whole. The Appellate Division affirmed the dismissal of the Commission’s complaint but reversed the dismissal of certain counterclaims, concluding that the Commission lacked authority to use a PLA because New Jersey and Pennsylvania did not have complementary or parallel laws on PLAs.The Supreme Court of New Jersey reversed the Appellate Division’s judgment. It held that the plain language of the Compact authorizes the Commission to require the use of a PLA in a publicly bid construction project. The Court found that the Commission’s broad powers under the Compact include the authority to use PLAs, even though the Compact does not explicitly mention them. The Court also determined that the Appellate Division erred in looking beyond the Compact to state laws that do not mention the Commission. Lusardi Construction Co. v. Dept. of Industrial Rel.
The case involves Lusardi Construction Company (Lusardi), a prime contractor, and its subcontractor, Pro Works Contracting Inc. (Pro Works). Pro Works violated certain Labor Code provisions by failing to hire apprentices for a construction project. The Department of Industrial Relations and the Division of Labor Standards Enforcement (DLSE) cited Pro Works for these violations and ordered Lusardi to pay penalties. Lusardi's administrative appeal was unsuccessful, and it subsequently filed a petition for writ of administrative mandamus, which the superior court denied. Lusardi argued that the superior court erroneously concluded that it knew of Pro Works's violations and that the joint and several liability provision applied.The Superior Court of San Diego County affirmed the DLSE's decision, concluding that Lusardi had knowledge of Pro Works's violations and was liable for the penalties. The court also found that substantial evidence supported the findings relating to the amount of the penalty assessment. The court rejected Lusardi's claim of due process violations, stating that Lusardi was put on notice of the potential for being held jointly and severally liable for Pro Works’s apprentice hiring violations.The Court of Appeal, Fourth Appellate District Division One State of California affirmed the lower court's decision. The court held that the superior court did not err in interpreting the statute, which provides two inclusive and alternative ways for imposing liability on a prime contractor for penalties resulting from the subcontractor’s violations. The court also found that substantial evidence supported the penalty imposed. The court concluded that Lusardi was not denied due process when it refused to enforce its subpoena or ask for a continuance to secure the witness’s attendance. View "Lusardi Construction Co. v. City of Aspen v. Burlingame Ranch II
The Supreme Court of the State of Colorado was asked to review a case involving a dispute between the City of Aspen and the Burlingame Ranch II Condominium Owners Association, Inc. The dispute centered around alleged construction defects in an affordable housing project overseen by the City of Aspen. The Association claimed that Aspen had breached express and implied warranties, and Aspen argued that the claims were barred by the Colorado Governmental Immunity Act (CGIA), which provides immunity to public entities from claims for injury that lie in tort or could lie in tort.The lower court agreed with Aspen, ruling that the Association's claims sounded in tort, or could sound in tort, and were thus barred by the CGIA. The Association appealed, and the Colorado Court of Appeals reversed the lower court's decision. The appellate court reasoned that the Association's claims could only sound in contract, and thus were not barred by the CGIA. The court relied on the economic loss rule, which generally provides that a party suffering only economic loss from the breach of a contractual duty may not assert a tort claim for such a breach absent an independent duty of care under tort law.The Supreme Court of the State of Colorado reversed the appellate court's decision. The court held that the economic loss rule has no bearing on whether the CGIA bars a plaintiff’s claims. The court clarified that the CGIA bars claims that could arise in both tort and contract, and that the economic loss rule cannot rescue an otherwise CGIA-barred claim. Stronghold Engineering, Inc. v. City of Monterey
Stronghold and the city entered into a 2015 contract to renovate the Monterey Conference Center. Before filing a lawsuit asserting a claim for money or damages against a public entity, the Government Claims Act (Gov. Code 810) requires that a claim be presented to the entity.
Without first presenting a claim to the city, Stronghold filed suit seeking declaratory relief regarding the interpretation of the contract, and asserting that the Act was inapplicable.Stronghold presented three claims to the city in 2017-2019, based on its refusal to approve change orders necessitated by purportedly excusable delays. Stronghold filed a fourth amended complaint, alleging breach of contract. The court granted the city summary judgment, reasoning that the declaratory relief cause of action in the initial complaint was, in essence, a claim for money or damages and that all claims in the operative complaint “lack merit” because Stronghold failed to timely present a claim to the city before filing suit.The court of appeal reversed. The notice requirement does not apply to an action seeking purely declaratory relief. A declaratory relief action seeking interpretation of a contract is not a claim for money or damages, even if the judicial interpretation sought may later be the basis for a separate claim for money or damages which would trigger the claim presentation requirement. City of Orange Beach v. Boles.
In consolidated appeals, the City of Orange Beach ("the City") appealed a judgment entered in favor of Ian Boles in regard to a dispute over the City's inspection of Boles' property. Between 2013 and 2015 Boles constructed two eight-bedroom duplexes on property he owned located within the City limits ("the beachfront property"). In September 2015, Boles filed a building-permit application seeking a permit to construct two additional multiple-level duplexes on the beachfront property. Additionally, in October 2015, Boles filed a separate building-permit application for the construction of a single-family dwelling on another parcel of property that Boles owned within the City limits ("the Burkhart Drive property"). At the time of each permit request, Boles completed a "Home Builders Affidavit" attesting that he was the owner of the property; that he would be acting as his own contractor on the proposed project, which would not be offered for sale; and that he was, thus, exempt from the requirement that he be licensed under Alabama's Home Builders Licensure Law. The building-permit packages provided to Boles explained that a certificate of occupancy for the proposed structure would not be issued until, among other things, "a subcontractor list has been submitted to the [City's] Finance Department." Boles also received with each package a blank subcontractor form for identifying all subcontractors for the proposed project, which specified that it was due within 10 days of the issuance of the building permits. Boles proceeded with construction on the two properties without completing or returning the subcontractor form for either property. Boles's electrical subcontractor apparently contacted the City to request an electrical meter-release inspection upon completion of the electrical portion of that project; the City refused. Boles contended the City either lacked the authority to and/or were exceeding their authority in refusing to inspect the beachfront property until the City received information to which, according to Boles, it was not entitled. The Alabama Supreme Court concluded the trial court erred both in submitting Boles's damages claims to a jury and in denying the City's motion seeking a judgment as a matter of law. Ex parte Alabama Department of Transportation
Baldwin County Bridge Company, LLC ("BCBC"), filed suit against John Cooper in his official capacity as Director of the Alabama Department of Transportation ("ALDOT"), seeking to halt construction of a bridge that ALDOT had hired Scott Bridge Company, Inc. ("Scott Bridge"), to build over the Intracoastal Waterway in Baldwin County. That lawsuit spawned three matters before the Alabama Supreme Court. In the first, Cooper sought mandamus relief because the trial court entered an order compelling him to respond to certain discovery requests made by BCBC; he argued the information sought was protected from disclosure by the executive-privilege doctrine. On Cooper's motion, the Supreme Court stayed enforcement of the trial court's discovery order to allow the Court to consider Cooper's privilege argument. Meanwhile, the trial-court proceedings continued and, before the Supreme Court was able to rule on Cooper's mandamus petition, the trial court granted BCBC's motion for a preliminary injunction to halt construction of the bridge. Cooper appealed that injunction, arguing that it was unwarranted and that the $100,000 preliminary-injunction bond put up by BCBC was insufficient. Scott Bridge filed its own appeal challenging the preliminary injunction, while also arguing that the trial court erred by dismissing it from the case and by stating that it was not entitled to the protection of an injunction bond. After reviewing the briefs submitted by the parties in all three of these matters, the Supreme Court concluded BCBC's claim on which the preliminary injunction was based was barred by State immunity. Accordingly, the trial court had no subject-matter jurisdiction over that claim and the preliminary injunction had to be reversed. Although the Court ruled in favor of Cooper on this point, it nevertheless rejected his companion argument that the trial court should have been directed to increase the $100,000 preliminary-injunction bond on remand. The Court also rejected Scott Bridge's argument that that it was entitled to recover on the preliminary-injunction bond. Finally, because the discovery that Cooper sought to withhold based on executive privilege was being sought in conjunction with the claim that is barred by State immunity, the trial court's order compelling Cooper to produce that information was moot, as was Cooper's petition challenging that order. Eagle Rock Timber, Inc. v. Teton County
After submitting the winning bid, Eagle Rock Timber, Inc. (“Eagle Rock”), contracted with Teton County, Idaho to reconstruct a stretch of road known as “Chapin Lane.” During the course of the project, Eagle Rock claimed it discovered unsuitable base material under portions of the road. Eagle Rock maintained that Teton County’s agent, Darryl Johnson, directed Eagle Rock to remove the material and said that the county would “make it right.” However, when Eagle Rock attempted to recover an amount in excess of the original Contract Price, Teton County denied Eagle Rock’s request, stating that it had not authorized any changes to the Contract. When the parties could not resolve this dispute over the amount owed, Eagle Rock filed suit. Teton County twice moved for summary judgment. The district court denied the first motion, concluding that genuine issues of material fact existed concerning whether Johnson orally waived the writing requirement and whether Johnson had authorized Eagle Rock to remove the unsuitable base material, which could support an equitable remedy. In the County's second motion, the district court granted it, ruling that since Teton County’s agent did not have actual or apparent authority to bind Teton County, the claims asserted by Eagle Rock failed as a matter of law. Eagle Rock appealed, asserting that the district court erred because there were still genuine issues of material fact that should be resolved by a jury. Further, Eagle Rock claimed the district court’s refusal to grant leave to amend its complaint to assert a separate cause of action against Johnson personally was an abuse of discretion. After review, the Idaho Supreme Court reversed the district court’s grant of summary judgment and denial of leave to amend. However, the Court affirmed the district court in not considering the ratification issue because it was beyond the scope of the pleadings at the time it was presented. Jones Brothers, Inc. v. Secretary of Labor, Mine Safety & Health Administration
The Tennessee Department of Transportation (TDOT) contracted with Jones to repair State Route 141. The project involved 68,615 tons of “graded solid rock” for the new road's bottom layer. To obtain graded solid rock, Jones leased land near the roadway, paying the property owner $75,282. Jones prepared the Site and began pattern blasting the limestone to produce appropriately sized rock pieces, using a “shaker” bucket to allow debris to fall away. Appropriately-sized rocks were hauled to the road site. The Site also served as a waste pit for material from the road repair. After several months, a Federal Mine Safety & Health Administration Inspector inspected the Site, determined that Jones had violated several Administration standards, and issued citations and orders.An ALJ ruled that the Site was a mine subject to the Mine Act, not a “borrow pit,” which is not subject to the Administration’s jurisdiction. On remand, the case was assigned to another ALJ, who indicated that she had read the vacated decision. Jone moved for recusal, citing the Sixth Circuit’s command that Jones receive fresh proceedings. The ALJ denied the motion and held that the Site was a mine, not a borrow pit, based on findings that Jones did not only use the Site on a one-time basis or only intermittently; engaged in milling, sizing, and crushing; and did not use the rock more for bulk fill than for its intrinsic qualities. Marin v. Department of Transportation
Decedent was employed by Jones as a construction worker. Jones was under contract with DOT to perform construction work on I-580 in Oakland. Much of this work was performed at night because it required lane closures. A car operated by a drunk driver entered the closed lanes of the project site and struck Decedent, who died on the scene.
A wrongful death lawsuit against DOT asserted vicarious liability for the negligence of its employees; failure to discharge a mandatory duty; and dangerous condition on public property. The court dismissed the mandatory duty claim. DOT offered evidence that it did not instruct or control Jones as to how to comply with its safety obligations but that Jones complied with its safety plan on the night in question and that the contract between DOT and Jones delegated to Jones the responsibility for selecting the means for performing, including ensuring worker safety.The trial court concluded DOT was not liable for Decedent’s death as a matter of law because DOT delegated to Jones its duty to provide a safe work environment and the conduct of the drunk driver was not reasonably foreseeable. The court of appeal affirmed, rejecting arguments that admissible evidence was wrongfully excluded. Plaintiffs failed to present evidence that DOT retained control over the construction site and actually exercised that control in such a way as to affirmatively contribute to Decedent's injuries, as required under California law. Save Our Capitol! v. Dept. of General Services
Defendant Department of General Services and real party Joint Committee on Rules of the California State Senate and Assembly (collectively DGS) prepared an environmental impact report (EIR) to determine the environmental effects of a project they proposed which would significantly affect the California State Capitol Building in Sacramento (Historic Capitol). DGS would demolish the State Capitol Building Annex attached to the Historic Capitol and replace it with a larger new annex building, construct an underground visitor center attached to the Historic Capitol’s west side, and construct an underground parking garage east of the new Annex. Plaintiffs Save Our Capitol! and Save the Capitol, Save the Trees filed petitions for writ of mandate contending the EIR did not comply with the California Environmental Quality Act (CEQA). The trial court denied the petitions. Plaintiffs appealed the judgment, arguing: (1) the EIR lacked a stable project description; (2) the EIR did not adequately analyze and mitigate the project’s impacts on cultural resources, biological resources, aesthetics, traffic, and utilities and service systems; (3) the EIR’s analysis of alternatives to the project was legally deficient; and (4) DGS violated CEQA by not recirculating the EIR a second time before certifying it. The Court of Appeal reversed in part, finding the EIR’s project description, analyses of historical resources and aesthetics, and analysis of alternatives did not comply with CEQA.
