This case was a challenge to the State of Washington's Building Code brought by the Building Industry Association of Washington (BIAW) along with individual builders and contractors. The impetus for this challenge was the State's 2009 requirement that new building construction must meet heightened energy conservation goals. At issue was the Energy Policy and Conservation Act's (EPCA) preemption-exemption provision, which expressly preempts state standards requiring greater efficiency than federal standards but exempts from preemption state building codes promoting energy efficiency, so long as those codes meet statutory conditions. Plaintiffs argued that the Building Code did not satisfy EPCA's conditions for exemption. The district court held that Washington had satisfied EPCA's conditions and therefore was not preempted. The Ninth Circuit affirmed, holding that the Building Code satisfied the conditions Congress set forth in the EPCA for exemption from federal preemption. View "Bldg. Ind. Ass'n of Wash. v. Wash. Petitioner, The Affiliated Construction Trades Foundation (ACT), filed a declaratory judgment action seeking a declaration that a public highway construction contract awarded to Respondent, Nicewonder Contracting, Inc., by Respondent, West Virginia Department of Transportation, Division of Highways (DOH), violated state competitive bidding and prevailing wage laws. The circuit court dismissed ACT's action, finding it lacked standing to challenge the highway construction contract. The Supreme Court reversed, finding that ACT had representative standing to seek the declarations. On remand, the circuit court determined that the Court's opinion in ACT I did not completely decide the issue of ACT's standing and ordered that ACT join the Federal Highway Administration (FHWA) as a defendant in the action. The Supreme Court subsequently granted ACT's requested writ of prohibition because the circuit court did not give effect to the mandate of the Court in ACT I, holding (1) ACT, as a matter of law, had standing to prosecute its lawsuit; and (2) FHWA was not an indispensable party to the lawsuit. Carolyn M. Louper-Morris and her son, William J. Morris, were convicted of, among other things, conspiracy and fraud charges related to the activities they carried out through their company, CyberStudy101. Louper-Morris raised six issues on appeal: (1) the district court erred by denying her motion to dismiss the indictment because the United States made a material misrepresentation to the grand jury; (2) the district court erred in overruling her objection under Batson v. Kentucky; (3) the evidence was insufficient to support her convictions; (4) the United States intimidated one of her witnesses thereby depriving her of the right to present a complete defense; (5) the district court erred by enhancing her base level offense for her role as a leader or organizer under U.S.S.G. 3B1.1; and (6) cumulative trial errors warranted reversal or at least remand. Morris raised six issues on appeal: (1) the evidence was insufficient to support his convictions; (2) the wire and mail fraud statutes exceeded Congress' authority to legislate in violation of the Tenth Amendment; (3) the district court erred by not allowing the jury to view the live website at issue; (4) the district court erred in overruling his objection under Batson; (5) the district court erred in enhancing his base offense level under U.S.S.G. 3B1.1 and 2B1.1(b)(9)(C); and (6) the district court's restitution order improperly included restitution to an entity that was already receiving compensation from a settlement agreement. The Pennsylvania Steel Products Procurement Act,73 Pa. Cons. Stat. 1881-1887, prohibits the use of temporary bridges made out of foreignsteel on public works projects. The district court rejected a claim that the law was preempted by the Buy America Act, 23 U.S.C. 313, and that it violated the Commerce Clause, Contract Clause, and Equal Protection Clause. The Third Circuit affirmed. The federal Act contemplates more restrictive state laws. Albemarle County enacted a zoning ordinance governing construction on slopes within the county. Under the waiver provision of the county code, the planning commission was authorized to grant a waiver from the restrictions otherwise imposed by the ordinance. Kent Sinclair, who owned property in the county, filed a complaint seeking, inter alia, a declaratory judgment that the county exceeded the power delegated to it by the General Assembly in violation of the Dillon Rule because its procedure for considering waiver applications was not authorized by state law. The circuit court granted summary judgment against Sinclair. The Supreme Court reversed the circuit court's judgment that the decision to grant or deny waiver applications may be delegated to the planning commission, as the delegation was legislative in nature and not authorized by state law. Accordingly, in enacting the waiver provision, the county exceeded its authority from the General Assembly in violation of the Dillon Rule and the waiver provision was void. Remanded. At issue in this appeal was whether nonunion Plaintiffs, Electrical Contractors, Inc. (ECI) and six of its employees had standing to challenge prebid specifications requiring the successful bidder on two state financed construction projects to perform all project work with union labor under the terms of a project labor agreement. The trial court dismissed Plaintiffs' complaint for lack of standing. The Supreme Court reversed the trial court's dismissal of the claims of ECI against the city and other nonstate defendants, and affirmed the court's dismissal of ECI's claims against several state defendants, holding (1) the individual plaintiffs did not have standing to bring their claims; (2) ECI had standing to bring its claims against the nonstate defendants, as it had a colorable claim of injury; (3) ECI had standing to bring its claim against the city for violation of the Connecticut Antitrust Act; (4) Plaintiffs' claims were not preempted by federal labor law; and (5) Plaintiffs failed to allege facts that reasonably supported their claims against the state defendants, and therefore, the trial court's judgment could be affirmed on the alternative ground that Plaintiffs' claims against the state defendants were barred by the doctrine of sovereign immunity. Excel Construction entered into a contract with the Town of Lovell to replace the Town's water and sewer system mains and service connections. Excel subsequently filed a complaint against the Town of breach of contract and related claims. The district court dismissed Excel's claims for failure to submit a governmental notice of claim that met the itemization requirements of the Wyoming Constitution and Wyoming Governmental Claims Act. The Supreme Court reversed, holding (1) Excel's notice of claim met the itemization requirements of Wyo. Stat. Ann. 1-39-113(b)(iii) and Wyo. Const. art. XVI, 7; (2) Excel complied with the service requirements of Wyo. Const. art. XVI, 7 when it served its notice of claim on the mayor, town administrator, town attorney, and town project engineer; and (3) the district court had jurisdiction to consider Excel's motion for leave to file a second amended complaint. Francis Weber was severely burned by hot mineral water when he lost consciousness in a steam room in Hot Spring State Park. Weber brought a personal injury action against several defendants, including the State. The district court granted summary judgment in favor of the State, concluding that it was immune from suit pursuant to the Wyoming Governmental Claims Act. The Supreme Court reversed, holding that the State's activities in the park fell within the statutory waiver of immunity for operation and maintenance of a public park as (1) overseeing building construction on leased property and delivery of hot mineral water to lessees are part of the State's operation of the park, and (2) under these circumstances, the State's operation and maintenance of the park included overseeing and/or inspecting its lessee's property. In 2007, Massachusetts Defendant No. 1 Steel Products, Inc. (No. 1 Steel) was a subcontractor on a construction project at a health rehabilitation center in Massachusetts (Cape Regency project). While working on the project, No. 1 Steel determined that it needed to hire out some of the steel fabrication for which it was responsible. No. 1 Steel found Alabama Plaintiff Garrison Steel Fabricators, Inc. (Garrison). No. 1 Steel was dissatisfied with Garrison's work and refused to pay Garrison anything beyond what it had previously paid. In an attempt to collect the remaining amount owed, Garrison sent No. 1 Steel notice that it intended to file mechanic's liens on the project unless it was paid. Upon receiving the notice, No. 1 Steel filed a motion in Massachusetts court to discharge and release the not-yet-filed-lien, arguing that Garrison was not registered to do business in Massachusetts and that no written contract of the parties' agreement existed. The Massachusetts court granted the motion without stating a rationale. In 2009 Garrison sued No. 1 Steel in Alabama court, asserting claims of open account, implied contract and labor and work performed. No. 1 Steel moved to dismiss, arguing a lack of personal jurisdiction. Upon review of the record, the Supreme Court found the "specific contacts" No. 1 Steel had were not sufficient enough that it should have anticipated being haled into court in Alabama; No. 1 Steel's relationship with Garrison was limited to a one-time purchase of customized goods. The Court directed the trial court to dismiss Garrison's case because the court lacked personal jurisdiction over No. 1 Steel. View "Garrison Steel Fabricators, Inc. v. The City of New Orleans appealed a jury verdict for Rosedale Missionary Baptist Church finding that the city violated the church's Fourteenth Amendment right to due process by demolishing the church building without notice. At issue was whether the suit should be dismissed because the church's procedural and substantive due process claims were unripe. The court dismissed the suit as unripe where the church did not allege a substantive due process claim that was independent of its procedural due process claim and where the court could not address the procedural due process claim without knowing the outcome of the takings claim, which was not before the court.
