Midwest Fence, which provides guardrails, challenged federal and state programs that offer advantages in highway construction contracting to disadvantaged business enterprises (DBEs). For purposes of federally-funded highway construction, DBEs are small businesses that are owned and managed by “individuals who are both socially and economically disadvantaged,” 49 C.F.R. 26.5, primarily racial minorities and women, who have historically faced significant obstacles in the construction industry due to discrimination. States that accept federal highway funding must establish DBE participation goals for federally funded highway projects and must attempt to reach those goals through processes tailored to actual market conditions. Midwest, which is not a DBE, alleged that the DBE programs violated its equal protection rights. The Seventh Circuit affirmed summary judgment in favor of the government-defendants. While DBE programs permit contracting decisions to be made with reference to racial classifications and are subject to strict scrutiny, they serve a compelling government interest and are narrowly tailored to further that interest. Remedying the effects of past or present discrimination can be a compelling governmental interest. The program provides states with ample discretion to tailor their DBE programs to the realities of their own markets and requires the use of race- and gender-neutral measures before turning to race- and gender-conscious ones. In 2011, the City of Omaha enacted an ordinance requiring contractors doing work within the City to obtain a license. Appellant challenged the ordinance on various grounds. As relevant on appeal, Appellant alleged that the passage of the ordinance did not comply with the procedural requirements of the Omaha City Charter, that the ordinance placed an unfair restriction on and monopolized the City’s contracting industry, and that the ordinance violated his constitutional rights. The district court granted summary judgment for the City on all but one of Appellant’s claims. After a bench trial, the district court ruled in favor of the City, concluding that the City was empowered to enact the ordinance and that the ordinance did not prevent Appellant from working on his own property. Demien, the unsuccessful bidder for the construction of a new firehouse, filed suit against the District under 42 U.S.C. 1983, alleging that the District violated federal and state constitutional rights, as well as state law, in the bidding process. The district court dismissed the complaint. The court concluded that it need only determine whether Damien has Article III standing under Federal law and not whether Damien has standing under Missouri law. Determining that Demien has Article III standing, the court concluded that Demien has abandoned its claims under the First Amendment by failing to argue them before the district court, and that Demien failed to allege that the District deprived Demien of any entitlement, and so it failed to state a claim under the Fourteenth Amendment Due Process Clause. The court concluded that, under Missouri law, there is no property right to the lowest bidder, and standing to bring a state court claim of deprivation of property rights does not establish a protected property interest. In this case, the District stated that it may accept the lowest bid, but does not need to. Accordingly, the court affirmed the judgment. View "Demien Construction Co. v. Defendants, an unlicensed residential builder; his businesses; and Denaglen Corp., a check-cashing service, appealed the Court of Appeals' decision to affirm the grant of summary judgment in favor of plaintiffs, homeowners who contracted to have their home restored following a flood. On appeal, this case raised four issues: (1) whether MCL 339.2412(1), which prohibited an unlicensed builder from "bring[ing] or maintain[ing] an action . . . for the collection of compensation," prevents an unlicensed builder from defending on the merits against claims asserted against him by a homeowner; (2) whether MCL 339.2412(1) provided a homeowner with an independent cause of action for damages arising from the statute's violation; (3) whether a contract for the services of an unlicensed builder was void ab initio or whether it may have some form of continuing legal existence; and (4) whether the trial court abused its discretion in refusing to set aside the default of defendant Denaglen Corp., the check-cashing service. In lieu of granting leave to appeal, the Supreme Court affirmed in part and reversed in part the judgment of the Court of Appeals and remanded the case for further proceedings. The Court found that the appellate court erred in granting summary judgment to the plaintiffs. While the Court of Appeals correctly held that MCL 339.2412(1) did not prevent an unlicensed builder from defending against a lawsuit on its merits and did not afford a homeowner an independent cause of action to seek damages for its violation. However, contracts between an innocent homeowner and an unlicensed residential builder were voidable by the homeowner and thereby effective in conveying rights and authorities to both parties and third parties. The Court of Appeals therefore erred when it declared the contract at issue void ab initio, "although that court's error was wholly understandable given the confusing state of applicable law." Finally, the trial court did not abuse its discretion by refusing to grant defendant Denaglen relief from its default. Duit, an Oklahoma highway contractor, contracted with the Arkansas State Highway and Transportation Department (ASHTD) to reconstruct I-30 between Little Rock and Benton. Duit encountered soil conditions that, it alleges, differed materially from information provided by the ASHTD during bidding. Duit’s claims for compensation were denied by the ASHTD, the Arkansas State Claims Commission, and the General Assembly. Duit sued under 42 U.S.C. 1983, citing the “in re Young” exception to Eleventh Amendment immunity. Duit alleged violations of the Federal Aid Highway Act, 23 U.S.C. 101, and the Due Process and Equal Protection clauses and sought to “enjoin Defendants from accepting federal aid … until . . . they fully comply with the federally mandated differing site clause.” The court dismissed the FAHA claim because that statute is enforced exclusively by an executive agency, dismissed the due process claim because Duit’s interest in future highway contracts is not a protected property interest and because the state appeals process for claim denials satisfies procedural due process requirements. The court declined to dismiss the equal protection claim, concluding Duit sufficiently alleged that the Commission treated out-of-state-contractor Duit differently from similarly situated in-state contractors without a rational reason. In 2004, Miller sought to build a four-unit condominium project on her Monona lot. The process stalled while Miller bought another lot, amended the plan, and abated an unexpected asbestos problem. She had unsuccessful negotiations with her neighbor, a former mayor, who trespassed on her property at the direction of city officials and took photographs for use at a planning commission meeting to oppose her project. Citations were issued for creating a public nuisance and working without a proper permit; the Wisconsin Department of Natural Resources issued a “stop work” order because of asbestos; Miller was required to erect a fence; and she was told that weeds were too high and was ordered to remove various structures. A court rejected three out of four citations issued against her, stating that, although “some of the efforts to enforce compliance were unreasonable,” Miller had not pointed to any similarly situated person who had been treated differently. Monona refused to adjust the taxes on Miller’s property to reflect the demolitions. Officials continued to trespass by parking cars on her property. In 2010, Miller filed suit, asserting equal protection violations. The district court dismissed, finding that Miller had not identified a suitable comparator and that there was no evidence that Miller had been treated unfairly because of her sex. In 2011, the Town of Middletown issued an invitation for bids on a drainage improvement project. Two contractors submitted bids, including HK&S Construction Holding Corp., which provided the lowest bid. Woodard & Curran, Inc. recommended against awarding HK&S the project and in favor of negotiating a contract with the second bidder. The town counsel concluded that HK&S’s bid was non-responsive and awarded the contract to the second bidder. Plaintiff filed a complaint against the Town and Woodard & Curran alleging, among other claims, that the Town violated state and local law when it denied the contract award for the project. The superior court granted summary judgment for Defendants. The Supreme Court affirmed, holding (1) there was no error in disposing of HK&S’s claims against the Town in summary judgment where HK&S failed to submit a responsive bid; and (2) HK&S’s claim of negligence against Woodard & Curran also failed. Appellee, a construction company, filed a complaint for declaratory judgment against Appellants, the Arkansas State Claims Commission, the General Assembly’s Claims Review Subcommittee, the General Assembly’s Joint Budget Committee, the Arkansas State Highway Commission, and the Arkansas State Highway and Transportation Department. The circuit court granted in part and denied in part Appellants’ motion to dismiss. The Supreme Court reversed and remanded on direct appeal and granted Appellants’ motion to dismiss the cross-appeal, holding (1) Appellee’s equal-protection claim was barred by sovereign immunity; and (2) the Court lacked jurisdiction over Appellee’s cross-appeal. The Jackson County Board of Education petitioned for a writ of mandamus to direct the Circuit Court to enter an order dismissing the complaint of D.C. Pruett Contracting Company, Inc. on the ground of sovereign immunity. Pruett Contracting submitted a proposal for renovations to the Pisgah High School gymnasium. The Jackson County superintendent of education executed a purchase order authorizing Pruett Contracting to make certain renovations to the gymnasium, totaling $231,309. Pruett Contracting then began renovating the gymnasium. The Superintendent later received a letter from the State of Alabama Building Commission stating that "all work on the renovation of the Pisgah High School gymnasium [was] to stop immediately" because the project had not been submitted to or approved by the Building Commission. The Board instructed Pruett Contracting to cease all work on the gymnasium. Pruett Contracting submitted an invoice to the Board for the work that had been performed prior to the letter. Months later, because it had not received payment for its work, Pruett Contracting sued the Board, alleging breach of contract and unjust enrichment and seeking recovery of damages on theories of quantum meruit, work and labor done, open account, and account stated. The Board moved the court to dismiss the complaint, arguing that it was entitled to sovereign immunity as to the claims alleged by Pruett Contracting and that the court therefore lacked subject-matter jurisdiction over the action. Pruett Contracting responded, arguing that this case involved a protected property interest, that immunity was thus precluded, and that the court had subject-matter jurisdiction over the action. The Supreme Court concluded the Board established that it was entitled to sovereign immunity and that the trial court did not have subject-matter jurisdiction over this action; therefore, the action had to be dismissed. Because the Board demonstrated a clear legal right to an order directing the Circuit Court to dismiss Pruett Contracting's complaint, the Supreme Court granted the Board's petition for a writ of mandamus and directed the Circuit Court to dismiss Pruett Contracting's complaint. Chabad and Rabbi Joseph Eisenbach filed suit against defendants, alleging that defendants violated their rights by denying an application to expand an existing property to accommodate Chabad's religious mission. Chabad filed suit under 42 U.S.C. 1983, 1985, and 1986; the Religious Land Use and Institutionalized Persons Act (RLUIPA), 42 U.S.C. 2000cc et seq.; and Connecticut state law, seeking damages, injunctive and declaratory relief, attorneys' fees, and the appointment of a federal monitor. The court concluded that the district court erred in dismissing Rabbi Eisenbach's RLUIPA claims for lack of standing; vacated the district court's ruling insofar as it concerned the Rabbi and remanded for consideration, instead, whether the Rabbi failed to state a claim under RLUIPA; affirmed the remainder of the judgment due to the Rabbi's failure to brief his remaining claims; concluded that the HDC's review of the Chabad's application was an "individual assessment" subject to RLUIPA's substantial burden provision and that the Chabad need not cite an "identical" comparator to establish a claim under RLUIPA's nondiscrimination provision; vacated the district court's judgment insofar as it concerned these RLUIPA claims and remanded for consideration whether these claims survive summary judgment; and affirmed the remainder of the district court's February 2012 judgment largely due to the Chabad's failure to brief most of its remaining claims.
